Are we being scammed?

Dear all, I bought an item which was basicaly a software download when I downloaded it was just somehing else, tried to communicate with the guy, he never responded, the account is no longer in existence.

I don't think eBay cover digital downloads with their money-back guarantee, but PayPal do. If you paid via PayPal then you should be able to make a claim with them.

I would also run a VERY good virus checker through the device/s

Yes, that sounds suspicious.

Of course, that's how some of these crooks operate.

If the account is no longer in existance, then eBay have shut it down, not the seller. Does it say on their feedback page that they are no longer a registered user, or has the account completely disappeared?

Try and lodge a claim with PayPal. Make mention that the account has been closed down by eBay. That usually speeds to refund process up a bit.
