I have lost.

 

eBay has sided with the scammer, even after direct proof that I was scammed. Response from delivery company attached.image.png

I opened a dispute under I have not received the item because that is the honest truth.

 

And that truth has costed me $3000.

$3000 mistake learned.

Because this item was for a solid price, and would've sold out, in my excitement I forgot to pay with paypal, and instead paid via debit visa. 

I was constantly asking support when they could help, and they told me to wait until the 8th before eBay could step in and look at the case. Between that time, the seller has the chance to manually refund me.

 

eBay refusing to refund is me having to go with all the trouble with ebay support, even though it was an obvious scam. And now I am fully out of my money.

The tracking number says it was delivered to my suburb, not my address. AUSPOST says the package was never intended for my address though.

Sadly, you opened the wrong dispute, that's why you lost.

I know that technically you did not receive the item, but when the tracking shows delivered and the post office says the item was of a different size and weight, the correct dispute is "item not as described". You could have added that you did not receive it either and could have added what AusPost said to the dispute, but because of all the red tape, when the tracking shows "delivered", you cannot open a case for "item not received".

If you used PayPal, you could still try a dispute in PayPal.

Maybe you can try a chargeback with your bank?

Sorry, but we TOLD you which case to open. Honesty has NOTHING to do with it. You were always going to lose a case that shows tracked/delivered - Ebay is completely black and white.

That is exactly why you should have opened ' item not received '.
