The seller had made only one other sale prior to your purchase, so it is very likely they are unfamiliar with eBay rules.

 

As others have stated, all you can do is file an Item Not Received claim. You will be refunded your purchase from the seller’s funds. 

Once you receive the original item, you can return it to the seller by arranging a PayPal payment from them to cover your return postage. 

they won't get the item....seller is 'away' until 18th May.....it will be done & dusted by then, surely?

You are probably right, but I’ve had items arrive 2 months late, so it’s not outside the bounds of possibility , albeit close to it in this case.

I don't think this is about a 'late' item as such. The seller said in a message to genie that they are overseas and cannot post it  till they get home, which is on 18 May.

So it is not on its way.

 

It's a mystery to me why the seller has not just refunded genie but perhaps they don't know how to do it or don't understand how ebay works. It's also a mystery why ebay won't allow genie to open a claim, but I think he needs to persist.

If necessary, he needs to go to the help pages and get onto ebay chat or request a call back, which I have been told is now available. But at the very least, go into chat and ask the ebay rep to look at the messages. Persist with the claim-that there is no item received and no item sent. And no tracking number.

 

PS As it is now 2 May, genie should by rights be clear to open a claim, you would hope.
