This lady claims to have braked but the vehicle took off.
Which would mean she hit the accelerator but this is a modern vehicle and the download of information indicated that neither the brake or accelerator were depressed.
So either she's lying or such an incompetent driver she has no idea what happened.
Looks like she's not going to gaol but I don't think she should ever be allowed to drive
vehicle ecu's do not record nor store such engine information... So it is not downloadable. if a scanner is attached to the vehicle then those readings are available in real time or for an amount of time.
Police forensic investigators can mostly determine whether the brakes are applied at the point of impact because the stop light bulbs are blown.
If the brakes are not applied and there is no current going through the filament (ie it is not glowing red/white hot) then the filament generally remain intact. Sometimes if the engine damage is severe enough and the throttle spindle, accelerator cable or TPS is jammed through impact damage they can determine an approximate impact throttle position...
. not that I know of anyways....
I read the OP's link and some others regarding the accident and none that i could find mentions downloaded information.
ECU's do need to "learn" some processes sometimes and will "remember" those processes.
Race cars through a bluetooth/satellite link are a different kettle of fish but that information is recorded an an external hard drive
