If it is more than 45 days and you funded the payment with your CC you can see if your CC provider will do chargeback.  Or you could ask the seller for refund and tell them that if you do not have the money back within 48 hours you are handing the matter over to the police "on line fraud" squad. 

But most importantly learn how eBay and PP works.  Never let it go past about 42 days to open PP dispute; you then have another 20 days to escalate to claim.
