I totally agree. I didn't think to look at the sizing in the photos, I only looked at the description. Now that the detectives have revealed the true size (well done!), then the OP has no choice but to refund. If they are a size 5, then that's what should be listed. Size 5 Redback boots in the men's category. I'm generally a 7-7.5 shoe and I wear either size 5 or 5.5 Redbacks (I can't always get size 5 locally). Both sizes are a comfortable fit for my feet. If I was a size 8, I'd need a 5.5 or a 6.

 

I also have to question if they were worn just once for a short period. They are scuffed in several areas that are evident in both the second and last photos. They are also creased across the toes. Mine have taken several wears for the creasing to start. They are made from good quality leather, so it takes a bit to get crease lines across the toes. Mine are for every day use and when I'm not wearing my thongs, I'm wearing my Redbacks. I recently bought a new pair that have been worn multiple times for several hours at a time and the crease lines are only just starting to happen (which was caused from me crouching down outside and being on my toes, not flat footed).

 

OP, in the event that you come back to read the replies, you have to refund the buyer and pay for return postage. You'll be able to recoup that cost by relisting for a bit higher price. If you don't refund the buyer and they've opened a dispute, if they escalate it and ask eBay to step in and help, they will close the dispute in favour of the buyer, they will be told they don't need to return the boots. You not only lose the money, you lose the boots too. Plus, you get a defect against your account and there's a chance the buyer will leave you negative feedback. That will almost end your selling career being a new seller.
