Perhaps those sellers breached other rules and the buyer had good reason not to pay!
FYI OP it is not against ebay policy to leave feedback for a non-payer - you may receive a policy violation if the comment is sufficiently negative enough to warrant removal if the sales contract-breaking, ebay payment policy breaching non-payer contacts ebay to request removal.
Please be clear I am not encouraging you to leave any feedback for a non-payer at all, let alone a negative comment that may jeopordise your ebay account - just correcting a number of errors in relation to the actual policy that is in place as I see it.
