Yes, it is illegal...Or at least, I'm presuming that nothing uploaded to YouTube is in the public domain.
Content uploaded to the internet (YouTube or anywhere), is protected by copyright and you can't use it - especially for commercial gain - unless it is expressly released to the public domain, or has a Creative Commons license attached that grants certain permissions with a few conditions.
