Thank you x3n0m. You sound as if you fully understand the situation. Happily or sadly, I really don't know which, I'm not the sort of person to allow this person to walk off with my money whilst he has a good laugh at my expense, literally my expense. I have just received 3 emails from him trying to get me to buy another computer with less damage. It only has marks in 2 places and a chunk missing from the edge of the "Brand New" Keyboard. He seems to think I'm an idiot. I've now told him 4 times I wish to cancel. Fair trading have told me he can't make any deductions from my money and because he's a registered business (working from home) they can act.
Should he ignore them then I will see out local sherrif and get him served with a summons to get my money back. He will then have to catch 2 flights to get here, pay accomodation and spend time away from his business. It will be so much cheaper to give me my money back. It only costs me $40.00 to reclaim over $400 so it'll be worth it. Plus he doesn'y have any chance whatever of winning. His Ebay sales will be mentioned in court and my 16 years working in the TV News industry has given me a lot of friends who owe me lots of favours.
This person is heading for a lot of grief should he insist on keeping any money. There are a number of similar complaints on Whirlpool about him. He's been pulling the same trick for a number of years.
Have you ever done anything other than simply talk about this behaviour on Ebay. Have you complained to Ebay? If not then you are part of the problem. I don't wish to be rude to you but when I see a problem I act and tell the right people what's happening. Ebay know me well for lodging complaints. I never bother to check if anything is done about those complaints and Ebay says it won't tell me. At least they've been told. In this instance they have little choice but to do something. Because if they don't I will make sure the matter is made public. That will make it look as if they welcome such illegal acts on their site. Something they certainly don't want to make public.
I never have any problems reporting these sharks. I simply don't care what they might think of me and to prove a point I will do whatever it takes. There goes yet another email from him. He's determined to sell his junk. Even after sending an email loosely worded from a solicitor he still thinks he can con me. He really should just return my money because he stands to lose much more than $400. If this goes to court I'll be asking for damages and anything else my solicitor thinks I'm entitled to. He may be able to win with Ebay but not the courts. Being a disable war veteran I'm entitled to the use of a barrister to fight this. The silly thing is a first year law student could win this blindfolded. He has absolutely nothing he can use in his defense.
I'm not apathetic and never will be. The older I get the more determined I get. I'm not going to be this persons front door mat. I think I've said it before, I can't understand how this person has managede to last so long. With an almost spotless feedback too. All I can think of is he does a lot of switching people to deal off Ebay or too many people don't care or too many complain verbally but not to the right people. I don't want to stretch this problem out and I certainly don't want the heartache it will cause but everyone has a breaking point and I've reached mine already. If I can stop one person from being subjected to this type of buying I'll be happy. Even more so if he's removed altogether.
