Problems with seller

Hello. I need help please. I bought a phone from a seller. The seller didn't declare that it was an overseas import. The phone is not 4G compatible and I requested a refund from the seller who refused to respond to my request or messages. Ebay doesn't want to help me either. What angers me is that the seller advertised a 24-month guarantee but changed it to 12 months when I enquired. I always select Australia only because I don't want to buy a phone from overseas. 12 months later, I found out the phone was in import and both the seller and Ebay said that they cannot help! What can I do? I paid over $700 for this phone.
