Joe. if, as you say, they are illegal (let's go with your scenario for now)
Why has eBay got a specific category to sell them????
http://www.ebay.com.au/sch/i.html?_from=R40&_trksid=m570.l1313.TR10.TRC0.A0.H0.Xe+cigarettes.TRS0&_n...
What's your theory on that one? mmmmmmmmmmmmmmmmmmmmmm??
And yes, you can 'smoke' them anywhere because there is no 'smoke' expelled

How true, i seen someone with one of the e-cigs at the shoping mall, security thought it was real until the person with it showed them, that person continued to have the e-cig with no hassle after...

That is completely and utterly incorrect. The sale of e-cigarettes NOT containng nicotine is completely legal in all AU states. It is only the sale of nicotine itself (a S8 poison) or the sale of e-cigs which contain nicotine which is illegal.

The previous links cover Qld & NSW, but apply also to the rest of AU. As long as no therapeutic claims are made, and the item contains NO nicotine, they are legal to sell and own in AU.
Prove it yourself (if you're capable). Simply Google: Are e-cigarettes legal? If you'd done so before spouting off with all of your BS, you'd have discovered exactly the same as I did, that they are NOT illegal in AU, so go pull your head in.
