I for one am working off the assumption that my fvf will be based in accordance with eBays fee policy published on the site.

These fees apply whenever an item sells and are calculated as a percentage of the total amount paid by the buyer (item price + postage)
There are no ifs or buts in the policy - it is quite clear. I will continue to expect a refund for any excess FVF that are charged for a transaction as per my contract with eBay and their own fee schedule.
