Selling items with no stock

I bought an item as i thought i would get it on time for what i needed it for.

But as the time had past the seller informed me they where waiting on stock to arrive now why is it allowed for people to sell items they don't have.

There should be some restrictions on the seller if they are not representing there listing correctly as you can't take money of someone for items you don't have.

REMOVED is listing lots of items for sale and no stock but the shipping is suggesting the items will arrive in a few days. 

I tried to raise a report but ebay does not have anything listed close to what the problem is.
