Do I need to keep an Unpaid Item dispute open for four days before closing it?

I have two questions.

1. Buyer has not made any contact since end of auction. I opened dispute three days ago but still have had no response from buyer.

Can I safely close it and relist the item yet?

2. Ebay say I can apply for a fee credit. Would that be a FVF credit?
