why are OS sellers allowed to sell e-cigs to Australia, but we are not allowed to sell them here?

I think it is actually illegal to sell them in Australia.

they have made e-gigs illegal to sell in WA, but it's only illegal to sell e-liquid with nicotine in it elsewhere here.

E-Cigs and liquid are not tobacco product yet ebay treats it as such.
