Purchased iphone 4 months ago and screen has frozen. Seller no longer a registered member of ebay

Description of the item purchased clearly stated there was a 12 month warranty. As the seller is no longer an ebay member, and it is well past the 45 days that ebay allocate for disputes, I guess i have been duped?!
