REMOVED offerred for sale by REMOVED which I have had various pieces of correspondence with through eBay was not in possession of the item at the time it was placed on eBay.
That persion should not be allowed to operate on eBay as such action is a breach of Australian laws.

1. It is against board policy to name and shame other members.
2. The boards are manned by members, and we can't help you. eBay neither read nor respond to board posts.
3. If you think the seller is breaking the law, perhaps you can prosecute them; you're a lawyer. Though not necessarily one versed in the intricacies of online trading.
4. eBay is at pains to emphasise that they are a platform only and that sellers are responsible for the content of their listings.
5. eBay provide remedies; perhaps you should use them.

Its called drop shipping and is allowed by ebay. A seller lists items from other companies and then gets them to send the item to the buyer direct. Its a bit like the ebay seller acting as an agent for the supplier.
It can all get a bit messy and adds another layer of complexity when things go wrong, but not illegal or against ebay policy.

It is not illegal to advertise something for sale when it is not in your possession.....as long as the seller states the correct location of the item.
A friend of mine lists things for her sister who lives miles away. They are listed with the correct item location and the sister posts them when they are sold.

Curious as to where you get your information from, why eBay would be investigating something they allow and how they will know you want the seller investigated when eBay do not read here
