ebay item not received scam

Hi, 

 

i have decided to start my own thread as i can see this is going to be a long drawn out battle against eBay to recover money from a buyer they refunded due to postage delays. 

 

The simple verision is that a buyer in USA opened a claim as item not recieved, as you all know there was postage delays. eBay decided because there was no tracking updates for 3 weeks to refund the buyer. 2 days after the refund the tracking has now scanned into NY USA

 

 

28th item purchased

 

28th item posted. 

 

5th april buyer asked where is item. 

 

Replied it is currently still in transit in Melbourne, delays expected. 

 

16th April Buyer said item is showing on USPS as not posted. 

 

Replied to check Aus post item departed australia 6th April but due to major delays expect it could take an additional 4 weeks.

 

17th april,  Buyer demanded refund because he purchased it locally. 

 

I replied as soon as it was returned full refund is not  problem. 

 

18th April buyer opened refund claim.

 

i explained the delay and said a refund would be possible once item was delivered and return planned. 

 

22nd april customer asked ebay to step in to resolved. 

 

Provided details regarding delay etc...

 

buyer sent daily messages item not moving 

 

27 april ebay was going to decide on the outcome. 

 

28 april ebay refunded customer. 

 

unable to call i had to open an appeal, 

 

29 april, appeal rejected because there was no new tracking updates. 

 

I have now asked for the to contact me as there is currently no way i cant contact them, they said it will take 24- 48 hours. 

 

 

After many denial requests from eBay, i have informed them i will proceed with legal action to recover the money from eBay, as there was suffiecnt advice made available to them that there would be world wide delays with mail services. 

 

 

What i can assure you is i will not lose out on this transaction as i blocked my bank account as soon as ebay was going to make a decision on who to side with, i had read enough to know it would be the buyer.  i know most people transact more than i do and its not possible to block your account, however i transact little at higher dollar values so it certianly better for me to block my bank account.

Just curious, did the buyer open the refund claim before or after you (I presume) lodged your enquiry with Australia Post? I see that both actions occurred on the same date.


i lodged an enquiry when i realized the buyer did not care about postage delays. the reason for the enquiry was to try and get an update as to when the item would recieve the next scan. the buyer never checked Australia post tracking once, he checked USPS which said buyer preparing item for shipment.

 

I had explained where the delays were from and the reason USPS only picks up the tracking once the inbound manifest is scanned. He did not care he did not want the item anymore he demanded i refund him, as i understand he does not have access to his refund yet as it is showing onhold because i blocked my bank account, which i will continue to do so until this is resolved.

My advice to you is not to appeal the decision just yet, eBay is well aware of the delays and in my case did not care. once the appeal is completed it seems like they will not accept any sort of error. 

Wait until you have reached the time limit of your appeal which i belive is 30 days but please check this because i am not sure.

So for my next update i will have to paraphase what eBay has responded with because i have been contacted by a moderator and told i cannot post any communications with eBay on here. 

 

 

they are basiclly telling me to work it out with the buyer who of course is unresponsive. funny advice eBay has given 

 

• Ensure that the estimated delivery date is accurate when listing an item

 

 

The delivery date was a standard post which they estimate not me. 

 

I am going to wait for the item to be delivered at this stage before i persue this further. 

 

eBay has agreed the item is still in transit and will be delivered, they reccomened i send the buyer an invoice which is just laughable consider the buyer was demanding a refund in the first place. 

 

I can't stress enough to any sellers who have high value items not to ship internationally at this point in time if you cannot take the loss.

Wait until you can confirm the package status.

 

If it shows delivered (not refused or anything like that), contact the buyer as per eBay's advice, tell them that you have now confirmed the package was delivered to them and that you're issuing an invoice directly, and payment is expected within X timeframe.

 

Then contact eBay, advise you have followed their advice, and that you'll pay your "debt" when they buyer pays theirs. Smiley LOL (Since you said you have blocked eBay from accessing your account, I presume the refund was funded by eBay?). 

 

 

In all seriousness, I would actually take an approach that's something like this, assuming I was 100% unwilling to take on the loss, but actually wanted to continue selling on eBay, as they'll de-register your account eventually for non-payment of the outstanding balance unless you can come to a resolution with them.

 

You can try to argue that the buyer's debt would be to eBay, as you can clearly show you fulfilled your obligation as a seller, and the refund was at eBay's discretion, therefore you have no liability for the debt.

Please explain the relevance of your question.

 

I don't even look at tracking, much less open cases with AP, unless I get a query from a buyer. I doubt I'm Robinson Crusoe. Neither is it germane to the issue of buyer/s claiming INR.

Possibly at about the same time, hard to say but it was still inside the delivery time frame regardless.

i decided to put my case together and email it to the entire board of directors and executives at eBay. 

 

Will they respond, dont know. 

 

But i think this comes down to a simple fact here, eBay is not taking any consideration of delays due to the virus when making decisions on how long a delivery should take and issuing refunds.
