managed payments

I have emailed ACCC

Ebay is now demanding they receive all Payments for sales through them, they are calling it Managed Payments. I am wondering if this is actually legal to demand how we accept payments. Years ago they tried to make it payment by Paypal only and the ACCC ruled against it,

The ACCC will have little to say on this matter for multiple reasons.

The first reason is because eBay aren't eliminating non-electronic payment methods. Sellers will still be able to receive bank deposit (not facilitated through eBay's managed payments system) cash on pick up (impossible to facilitate through managed payments) and presumably other non-electronic payment methods too, though I doubt they are used much these days, if at all (COD, cheque, money order).

The second reason was that the ACCC's previous decision was based - in part - on consumer choice. Having sellers only being able to offer and receive PayPal payments reduced consumer choice. eBay's managed payments system only increases choice of payment methods available to buyers.

The third and final reason why I know the ACCC will have nothing to say is because similar systems to eBay's managed payments already exist in Australia, some without the option for buyers to pay through non-electronic means - just look at the limited payment options available to buyers on Amaz*n Australia, and the fact that they also manage payments for sellers, which are periodically paid into a nominated bank account, but without the flexibility of being able to choose daily payments.

A bank deposit does not have any buyer protection, that was why it was ruled that eBay had to provide at least one method of payment that did have buyer protection.

The difference with what they are doing with Managed Payments  is that  you have to post the items before you have even got the money.

Wrong, the seller will receive the full payment, once it is received they can then post off the item.

Paypal pays your money into bank account within a day how long is going to take FEE Bay to transfer the money about a week or more probably so they can make interest on it. So we are all out of pocket until they decide to transfer our money.

Read my above post, you don't send until you have received payment, how long that  will take nobody knows at this stage, it could be the same as a paypal transfer or it could be a little longer.

A paypal transfer is not required to make a payment with money received into paypal, meaning that money is available instantly. So comparing how long it takes to transfer to our bank from paypal (not required before money can be used) with Ebay transferring to our bank (required before we can use) is like comparing apples and oranges

Sheesh dusty, I said NOTHING about transferring money OUT of a Paypal account, I was talking about a transfer between the buyer's Paypal account and the seller's Paypal account.............

notice a lot of comments about payment time freames ect...

what i am not seeing is any comment about the increase in base fees across the board, effectivley these priates are removing or seriously reducing the ability to choose whom get your hard earned, the fees they are claiming to be saving by removing Paypal have just been tacked on to final value fees, in effect no savings what so ever, they have even tacked on the processing fee that other option charge.

difference is i can spend directly out of my paypal account to many other service and/or parts suppliers.

if they left their final value fees as they were and only added a processing fee then maybe, but this B/S is highway robbery. time for my own inhouse web based browser, might not get as many sales initialy, but atleast 11% of my earn wont be taxed by Ebay, not to mention the scam fees added to postage cost. sure this business would've negotiated a kickback/agents fee for the astronomical volume of business pushed through aussie post. 

will activly resist moving to managed payments in its exsisting form and fee structure.

Discussion with ebay advises that "daily" payments to your bank account can take up to 2-5 business days to actually get there due to "processing". So daily payments AREN'T daily at all. Weekly payments are sent to your account every Tuesday, which is pretty much just the same as a daily 2-5 business day processed payment. Ebay sit on OUR money while it is being "processed" investing in short term money markets, where they are making more than the sellers are. 

This new managed payments is the second worst thing ebay has ever introduced, FEES ON POSTAGE WAS THE WORST.

You can mostly blame that on the unscrupulous sellers that had astronomical postage on their items to avoid paying their fair share of fees to eBay.

At the risk of sounding like I'm defending eBay, if they're processing payments each day—regardless of whether it takes 1 day or 5 to show up in your account—how is that not daily? Some sellers have reported the funds hitting their account the day after eBay transfer it out, while for others it takes longer, presumably due to the differning clearance times that exist between various financial institutions.

And how do you know eBay are invensting it in short term money markets, and what they make from it? Why aren't you doing that instead of selling if it's a more profitable business activity?

Oh, and on the subject of chargebacks and stuff, I hope you all read this little gem on the ebay "Managed Payments" info page:

Dispute fees

When you are found responsible for a chargeback or other disputed amount as per eBay's policies, we charge a dispute fee of $24.20 (incl. GST) for each dispute.

There you have it. If we get stung by a dodgy buyer who convinces ebay that we're the problem, we get charged $24.20 for the pleasure of having our payments frozen/delayed/withheld.... Seller beware.
