Seller still selling 18v battery for AEG tools for $42 which was faulty and did not retain a charge - I was offered a replacement or cash back. I asked for a replacement but they said the batteries were now being sent for quality testing and could only offer cash back, which they then processed. So no loss of money. However, they are still advertising / offering the same battery for sale. Should'nt Ebay look into this seller? Tried the feedback reporting but I found that the options did not cover this topic.

Have a look at their feedback page, are they registered in China by any chance ? What is the item number of the battery ?
Batteries for cordless tools are one of the most common things that Asian sellers produce as fakes.

Just checked and the seller I purchased from (yes China) is still selling along with 4 other (roughly counted) sell Thoughty I'd give my purchase a go as I have bought replacement batteries b4 and did not have any issues. This is the first transaction of this kind I have come across. But at least I got my money back. Thanks for the update. I shall be more wary going forward. BTW it was a "4000mAh 18V Li-ion Battery For RIDGID R840087 R840086 R840085 L1830R AEG BHO18" and the seller had a "5130 98.8" feedback positive rating.

This one ? definitely a fake, be thankful you didn't leave it on charge and burn your house/shed down.
In future be very wary of buying any electronics from Chinese sellers, in general any high-volume seller with less than 99.5% feedback should be treated with caution.
Edit to add, Here's a geniune one :-
