Does the seller have to refund for DOA item

I want to bid on this Asus tablet and it is listed as new and only taken out of the box for the photos but what I am not sure about is if it arrived DOA would I be covered with PayPal or under warranty with Asus. I emailed the seller but did not get a clear answer just a link to Asus website. This is what is stated on the item after the item details. Any help would be much appreciated as the item ends today.
