I have two items held by Australian Customs because EBay Global Shipping using Fedex did not do the custom form right.
If they are not released by customs can I get my money back.

If you paid by PayPal, I would ensure you open a case for item not received before the 45 day deadline.

That will give you a further 20 days before you need to escalate to a claim.

 

However contact the seller beforehand and give them a chance to rectify the issue, but don't let them talk you into not opening the case or closing it before you have a refund. 

If it gets to a PayPal case and in order to win you will probably need to supply document proof to PayPal that customs have seized the item/s due to incorrect or insufficient documentation. As import seizures due to customs regulations are the responsibility of the buyer, not the seller. Whether customs are prepared to fax you something to support your case, I am not sure.

 

Hopefully the seller is prepared to refund if items are not forthcoming.
