Is it against rules of ebay when you have won an item but the seller deems that they no longe will sell this item to you???

Bidded on an item and won the item. The seller then sends me an email saying that they arent selling me the item at the price I won it for.  They had a ridiculous comment in the listing basically saying that if it didnt reach $350, they wouldnt be selling it.

 

I replied to them that it was a shame as it was the second item in a week that hadnt gone through. The seller then offered to sell me the item for a higer amount than the winning bid to which I replied and said pass. 

 

Surely this is not an acceptable practice on ebay. Have since noted that the same seller at the moment has a couple of listings more or less saying the same thing again. Does this seller run under different rules to everyone else ss he seems to be a rule unto himself

No it is not acceptable but you can not force the seller to sell.

Report them as a non performing seller and leave a neg to warn othes

seller refuses to complete sale on low end price.
