What are the rules and regulations of listing the condition of an item being sold.

Hi,  I purchased an item on Ebay which was listed as Used. The seller mentioned the glass protecting the lens was smashed and from the photo he posted the glass was clearly broken, but it's only a protection matter and the camera will still work without the glass.

 

Basically I was scammed as the seller fauiled to mention the camera didn't work at all. I inrended to buy the camera and use it until I found another one of the same model and change parts.

 

Is the seller wrong for not mentioning the camera didn't work or is it my bad luck. Two years ago I paid $2,000 for a "New" computer and because it was dirty and covered in scratches I asked to cancel the purchase, the seller said OK and kept almost $500 "for  cancelling the purchase" Please note I cancelled the purchase within 2 hours of paying and he sent me photos of the computer and it was still sitting on his bench unboxed, plus the keyboard was smashed along one side, This is why I cancelled. 

 

It seems new no longer means what it used to and now I'm wondering what the word used means, I've searched and can't find the info on Ebay.  I'm not going to ask for a refund, the postage back to the seller would be more than I paid for the camera, this is only a matter of principle. I've seen the message on listings saying it's supposed to mean it's usable but maybe marked, but I just want to know if simply telling me a piece of glass is smashed means he can get away with selling something which doesn't work.
