item is not functioning correctly

Purchased a mobile phone, samsung note 3 which has a "pen"

the phone will not "recognise" the pen

we have tried other pens and the phone will not recognise............so it is a phone fault

 

have sent numerous emails to supplier, we want to return the phone under warranty, seems to be delaying

the phone has not been paid for by paypal yet, 

what do you think?

supplier is in sydney, we are regional
