item not received and not covered by guarantee

Hi everybody,

 

I purchased an item on 14th December. It had tracking and appears to still be with the courier company, although it does not state which one. I have contacted the seller numerous times and was told to wait.  The final date for arrival was Jan 25 and I did try and lodge a refund request through Ebay before that date but the message came back saying I was unable to.

 

On the 27th Jan I contacted the seller to ask for a refund that they had promised me and I am still waiting for a reply - they were usually very quick to reply to all my previous messages.

 

The real guts of my question is why am I not protected by an Ebay guarantee and why will they not help me get my money back if there is an issue?

 

I only buy things every now and then and this is the first time I have ever encountered this.
