The seller listed 3 items available for $349.00 each but after I purchased & paid for one of the items the seller sent me a message that says there are none left & I will have to choose something else for the same price.
But the very same add (that I purchased from) shows he still has the same item listed for sale and that he has sold the same item that I wanted to someone else after my purchase.
Now this same add lists only one item left.
The add that I purchased the goods from still lists that there is one item for sale at $349.00 but then he has another add on ebay that lists the exact same item for $399.00.
I think he is telling me lies and that he is fishing and the add I purchased from was just bait.
I no longer trust this seller

The purchased item was not covered by eBay buyer protection either, which wasn't advertised by eBay or the seller untill after the purchase & only found out when I tried to leave feedback. But I cancelled the order & told seller I would get bank to do a charge back if he did not refund. He was indifferent about it all & hesitant but he eventually refunded me.

Seller sounds super sketchy.
You can write back and tell the seller that you will not be choosing anything else and that he needs to refund you, or you will get Ebay involved.
Did you check out the sellers feedback?
Were there any red flags?
What is their feedback percentage?

Go through the buyer channels - put in a claim - INR - as soon as you can.
If the seller does not refund - immediately.
A full refund - should be on the way.

I'm with domino on this.
Stop communicating back & forth with the seller.
The seller is very dodgy.
I can see you are relatively new to buying on ebay-or your feedback score gives that impression. The seller is banking on you not knowing how things work.
First off, if the seller does not have the item he sold, he needs to cancel the sale & immediately refund you.
He doesn't want to do that because well, ... money. Plus the fact if he has to cancel and tick a box that says he is cancelling because he is out of stock or whatever, that is counted by ebay as a defect on his account. I think that's correct.
You do NOT have to choose another item. He is bluffing you.
Do not communicate further with this seller except to say you want a full refund immediately or else you will have to go through ebay for a claim.
If that refund is not forthcoming within a day or so, go straight into an ebay claim asap. You may have to wait till after the last day of expected arrival of the product but definitely open asap. And follow through with your claim.

There are only a few categories that don't have buyer protection with the MBG as shown below. Was your item in any of those categories ?
If your item was not in those categories then protection through the MBG would have applied, unless you allowed the time period to lapse (30 days after the final ETA of the item).

Yes it was a $349.00 (+ $39.00 postage) Pocket Bike.
In other words a small 49cc motorized mini bike.
My daughter has since tested his site and tried to order the same bike that I wanted (Yes, it was still advertised for sale a week later) and he tried to pull the same scam with her.
She ripped it up him & told him that she was going to report him to ebay & PayPal & he has finally listed the bike as being out of stock. I bet it changes back though after a cooling off period. Any way I have still seen it listed under another category (Children's Ride on Toys).
Also, after I tried to buy it & was refused buy the seller I checked the "item history" & it showed that he had sold that same particular bike to someone else a day later. So who knows what is going on because I don't. I'm just happy I got my refund.
