Yes it's too early to open an INR but my main concern would be the feedback left for this seller and therefor I wouldn't have purchased from them at all.

Seller has sold 15 of similar items in a few days and listed them in a category that doesn't have protection.
Looks like they knew what they were doing and scammed.
Didn't you look at the feedback before buying?
Seller is in China, not much chance of getting your money back.
Chalk it up to lesson learnt.

Ok the buyer was scammed but kopes I think in this case ebay are partly to blame also because ebay should have removed the sellers listing for not having the listing in the correct category.
I have had a few listings removed for not having them in the correct category immediately after I listed them so why didn't ebay pick up the sellers incorrect listing category??
I would be asking ebay this question.

Unfortunately ebay can't vet millions of listings and it would require someone looking to see that the product is indeed listed incorrectly.
So it's caveat emptor.
As you know ebay rely on reporting from members and each listing has a report link but there are a few of us regulars that have taken turns in reporting listings in incorrect categories (pocket bikes was often used) and ebay are slow to react until they can see the account has obviously scammed.
I agree crow, ebay need to be far more proactive in eliminating unscrupulous members.
It would boost comsumer confidence and sales, it's not rocket science.

I too wuld be on the phone to ebay asking why they allowed a seller to list in the wrong catagory which meant you had no buyer protection wen you would have had it been listed correctly. If you do't get anwhere ask to speak to a supervisor. If you funded the payment with a credit card you could contact your bank about a chargeback.
The fact the listing says the seller is registered in China, the item is located in Australia and it is being delivered from overseas should have had alarm bells ringing.
It says in this book I am reading that by 2065 80% of women will be overweight.
See what a trendsetter I am?

Taking in everything that pj has already stated, plus others, without sounding cruel or harsh on the op, what would one expect to receive for $37 Australian ? Take a look at the item in question, wow.
Yes, Seller located in China, the "Goods" located up coast in Ozzie, freight coming from outside Australia, would have had Bell's rebounding in my head, till l woke up to .....am l being set up for a "Sting, or a Scam" you bet . !!!
I feel for the Buyer, but maybe we just need to not be over excited about the PRICE, and actually read all the info. first, before one parts with hard earned funds.
