I got my item today after it sat around some AP/Customs facility for 2 weeks. It was one of those poster tubes, and had been smacked up against something that hard it split open and my item has been damaged. It was well packed by the seller who was concerned why it had taken that long to delivery.
I believe he has done his up-most to protect it, and the damage looks to be deliberate.
My question is can I make a claim on PayPal without any loss on the seller?

I am guessing customs have ripped open the material of the tube to see if has any powder inside the layers of cardboard.
I would contact customs and ask what the procedure is if customs have damaged the item.

If you get a refund from PayPal, they will take it out of the sellers account.

Naw it was smashed against something, as it creased and damaged the print as well.

Did the seller purchase insurance? If so, they should be able to make a claim with photographic evidence supplied by you, and then (hopefully) pass on the compensation (perhaps they'll offer to refund or replace, and seek compensation independently - that's what I would do, anyway).

If Customs opens a parcel for inspection they always put a brochure inside to explain what has happened. They then seal the package back up with black and yellow tape stating resealed by Customs on it.

Now that you mention it, that's true. Been watching too much of USA customs shows.
OP as digi suggests perhaps the seller had some insurance or can do a direct claim with AP.
(Hate it when AP drivers think they are Darth Vader and start using parcels as light sabres)
