Open a dispute via paypal and then once escalated to a claim they will tell you to return it.

Then call them and tell them about the battery and it would not be cost effective to refund and often they will refund you anyway.

This postal regulation only applies if the battery is internally fixed and is not removable. If it has a separate battery compartment then the lithium battery simply needs to be removed before the item is returned to the seller.

Incidentally, Registered Post International is the Paypal-approved service I use to return items to China or Hong Kong, and if you arrange with the seller beforehand, you'll generally only need to return the actual faulty GPS and not all the accessories which add to the postal weight, therefore costing more to send.

Each time I've had to return an item, the postage has set me back $17.90 plus the cost of packaging.

BTW, have you checked that the charger is outputting 5VDC as they all should? It is entirely possible that it is only the charger which is faulty, in which case you can either use a different charger, or ask the seller to send you a replacement immediately.
