I bought a Mobiki Mobile on the 17th August with a 12 month warranty. By November it had a black patch on the screen which mwant you couldn't read messages or indeed anything. I approached the seller for a refund or a replacemant but never heard from them so came to Ebay for he but was handed on to Paypal. I am 77 and not really up with these things so because I didn't escalate it to a claim it was canceled. When contacted I was referred back to Ebay but to date have not heard anything. i am very disappointed with the service I received and am $99.94 out of pocket and will still have to buy another mobile phone. Can anyone help please?

lyndal,
when I said you - I didn't mean you, it's the usual manner of speaking when explaining something.
I thought you would know that, didn't even occur to me to clarify it specially!
The only question I had for you was one relating why would you need to do a bank charge, I though everyone can just claim from Ebay or PP - within their timeframes.
And if both of them knock them back - that's that then - they obviously don't have a valid reason to get the money back.
And, no I didn't know about PP charging buyers, never made a claim as yet.
There were few times I almost did, but then I am one of those suckers who always feels sorry for seller - especially a small seller - and never could bring myself to ask for a refund. Money back wouldn't have been worth the anguish., thinking about the seller and wandering if they need the money from their sales to survive, or how many kids they may have, and that sort of thing.

Things are very different not to what they were when I did my two chargebacks.
In those days there was no such thing as an ebay dispute....these are a very recent "invention".
And the paypal time for a dispute was just 45 days, not the 6 months that are allowed now. In the very early days when a buyer made a claim they had to foot the first $45 of the claim

It was never a case of "both" ebay and paypal knocking anything back. There was no such thing as an ebay dispute and paypal did not knock anything back. The seller did not answer the dispute and paypal closed the dispute rather than automatically refunding my money.
The same thing happens these day.....we see enough members coming to the boards complaining that ebay and paypal have not followed their own policies.

Just because you choose not to make a claim there is no reason the turn your nose up at those of us who do follow through when we are owed money.
