I'm feeling stoled by Ebay and not heard at all....

I agreed with a date with the seller prior purchase because I'm not a US resident and I was travelling from Brazil to Hawaii. As every time I'm the US, I buy things to ship to my hotel and never had a single problem. This time is just fell that Ebay don't read the full message. They think I'm mad because the Item was delivery late....but it is not. I never got the item. 

Before purchasing the seller agreed that the item would arrive prior a certain date and it didn't. When I sent a message to the seller, he opened a dispute and Ebay gave on his favor. They say the item was delay because the seller was on vacation. But they don't understand that I didn't got the item at all!!! 

And more funny than that is days latter, the seller contacted my asking for a 5 star. What else I can do to get my money?

FACTS:

-          On August 17th I sent a message to thesalondepot asking if I purchase the Item if it would arrive in Hawaii prior August 30th

-          On the same day I got a answer from <removed> saying that YES.

-          I placed the order on the very next day, 18th.

-          I left United States of America on the 30th without my purchase because it didn’t arrive to my hotel.

-          On September 5th I open a case <removed> explaining exact what is above.

-          On September 9th I received an answer saying that the item got delay because the seller was on vacation. We had an agreement that is clearly stated on the messages exchanged wit the seller. The seller should had comply with it!

-          On September 11th I got a final response from Ebay saying that a final decision in favor of <removed>

-          On September 30th I got a message from <removed> asking me to give them a good rating. When I told them that I didn’t got my item they said: “What is the issue - I haventreceived any messages? What is the problem?”. It is all documented on everyone’s Inbox.

-          PLEASE READ: I never received my shipment and I’m more than 50 dollars down at this point!!!! I don’t leave in United States of America, thus we had to commit with the agreement in the beginning, that is until when I was in the country!

Hi Fred, I can understand your frustration.

Do you know if the seller did send the item and it was the fault of the postal service that it didn't arrive in time?

Perhaps it has since arrived at the hotel, have you checked? The seller cannot help the postage service, that is really out of their hands. It's one of the negatives of buying on line really.

You mention raising the issue with eBay, have you also done this through PayPal?

But if the seller has posted it, even if it was late and it is his "fault", then I don't think that there is really anything you can do.

Check with the hotel (or the delivery address you supplied, maybe it is there by now.

fredericotm not sure which part of the world you are in now but I see you are a US registered user.

Just in case you are not aware, you have posted to the Australian discussion boards and the way disputes are handled in Australia are different that the US.  It may be best to seek advice on the US boards.
