Bought 2 pairs of kids swimmers-opened 1 pack,perfect so left pos feedback for BOTH even though I hadn't opened 2nd packet :_|
2nd pair looked they'd been torn by shredding machine although NO damage to packet itself.
Emailed seller & attached 4 photo's.
Seller said-in VERY bad English-you cut them.
I was like WTF??
Long story short,they refused to replace,they only cost $12.99 per pair with free postage.
Opened Paypal dispute,sent photo's to Paypal also,was told to return ???,told Paypal at least 6 times that
1-Would cost WAY more to return than item cost
2-I was NOT claiming for 2 pairs of swimmers,just the ONE damaged pair.
3-I did NOT want refund,just replacement of the ONE pair of damaged swimmers
ARRGGHHHH
So just now,Paypal has decided no one is at fault & they have refunded me for BOTH pairs from Paypal money NOT sellers account.
Not sure if I should :O;\:^O

LOL, well you got a pair of swimmers for free 🙂 Now you need to find another seller to get the second pair.
Hope you are still able to leave FB to the seller. I know what I would be leaving ]:)

Are you talking to me TB? I did not miss anything; Foxy got one pair of swimmers in good condition, left FB before opening the second packet. The second swimmers were damaged. Got refunded (from PP - NOT seller) for both without posting them back. So she has one pair of good swimmers courtesy of PP. 🙂

Yes and as stated she left feedback for BOTH before opening the second packet, meaning that she can't change her POS to a NEG

The saddest thing is,my granddaughter REALLY wanted those pink swimmers as they matched her sisters yellow ones & if seller hadn't been such a pig to put it bluntly,I'd buy again from them.
Will look for another pair for her when she comes home from school.
JMO but still think its weird Paypal refunded TOTAL purchase when I was soooo foxen clear that only ONE pair was damaged.

the seller didn't make them obviously. From what I can read of the original post, sounds like they are made in bulk from machines then sealed and packed, seller wouldn't have known
But, the seller is responisble if the item is not as described an just like you Foxy, i would have wanted either a replacement or a refund, but the seller should cover the cost of the damaged item being returned, afterall it wasnt your fault it was damaged so you should have to pay to return it
Good to see you got a full refund, worked out in the end

Oddly enough, buyer pays for return postage is a PayPal thing only.
If you look at the Sales of Goods Act, if on receipt of goods bought on description, if they are not significantly as described, the buyer is entitled to reject them and if the seller want them back, they have to pay for them to be returned.

And just how would you suggest a buyer enforces the Australian sale of goods act with a seller who is in China.
It also does not apply to a private seller or to auction goods.
