If paid by PayPal, you have 45 days to open an Item Not as Described case and will be asked to return the item via trackable means at your cost to the address PayPal specify in order to get a refund of item plus initial postage cost.
Yes, if it is not working as described it is enough grounds to open a case within the 45 days.
To do so select resolve a problem to the right of item in your purchase list.

I don't believe any seller would be agreeing to a 45 day warranty unless they stated that in the ad.
My own personal belief is if you buy something (small) second hand and it is working when you receive it then it would be a case of buyer beware, and if it broke down a little later you would not be entitled to a refund..
However, that might not be the way paypal sees it and you might win a case if you put in a claim.

Agree with springy, but especially with electronics, after they have been warmed up properly a fault may occur that would indicate the component was not quite right from manufacture.
And an item that has been shipped then used by the buyer maybe 1-2 weeks after purchase then breaks down within 2-3 weeks of normal use, I would deem as faulty and Not as Described.
I think that is one of the reasons PayPal has a short time of 45 days to claim.
