Question for tall-bearded. Refunds online.

Hi tall -bearded I have a quick question for you. Is it legal to state "No refunds on sale items". I purchased an item only because the listing  basically said happy to refund so long as 1) in original condition. 2) not used and tags still attached. 3) within 2 weeks. When I printed out the return form at the very, very bottom the dreaded condition appeared. I though the listing was deceitful because it said there were only three conditions required for fuss free refund. Thanking you in anticipation.

tall_bearded just one more question/explanation please?



If I collected stamps years ago in the hope that one day the stamp album would be valuable and sell for a really good price, is it different to collecting stamps years ago because I liked the stamps but hard times have hit and I sell the album for a really good price?



Maybe there are too many shades of grey for me to get my head around?

Bump, I was told by the ATO that the test of running a business is whether you bought the item with the express intention of resale. If you had bought two of every stamp then you would be deemed as buying for resale, but if you have only one and you have had it for some time, then the tax office would take your word for it that it was a personal collection that you are selling for whatever reason.

Thanks Lyndal , it is all too confusing for me but I should be OK because I only sell clothes that are the size I wear. I have bought something thinking that if it doesn't fit I can sell it so I should be OK.

Sorry been away for a day or two’s fishing.  Weather not too good.  High winds and nothing much biting.


 


For the purposes of legal studies there are whole textbooks devoted to whether or not an activity falls within the definition of a business, which of course means, when posting on these boards you can only scratch the surface and deal in generalities.


 


I-once-was-bump - in answer to your question this kind of activity would ordinarily fall within the classification of a hobby.  We all collect things knowing that one day we will need to divest ourselves of them, in the hope that we get more for them than we paid for them, but all other things being equal, and I stress, all other things being equal, this kind of activity would ordinarily fall within the definition of a hobby and therefore be income tax exempt.  That is, there is a fundamental difference between divesting oneself of an asset, as distinct to operating a business.


 


However you need to be wary of the 2 year trap, in that, if it is bought in the circumstances as described and you sell it before you had it for 2 years or more, and if you sold it for more than you paid for it, then the profit generated would be subject to Capital Gains Tax.


 


I know clear as mud.  So my advice to anyone who is thinking of selling in line: everything you do is in the public domain, and organisations such as the ATO and DSS, with their data matching capacity (which is improving every month), they are watching every move you make.  So if you’re regularly selling on line, get professional advice as to what your current status is.

I know . . . . I am being petty . . . . but with all the talk on the boards about regular posters picking on, ganging up on, and 'stalkering' newbies . . . . . I thought it only fair to pick on a regular to show that nobody is exempt and that we don't play favourites.
