Seller asked me to return deective item and I never received a replacement

I purchased an item in July, contacted the seller 3 weeks later and asked if he stood behind his items because it stopped working.  He said of course and if I returned the item to him he would gladly replace it and pay for my shipping costs.



I returned the item in September and sent several unanswered emails asking about the item.  Finally contacted him by phone and he apologized saying his email is filtered and that he would ship the item as soon as I resent him my address.



I provided my address the next day and a week later (and 3 unanswered emails) he replied saying he had shipped my item and would provide me a shipping number when he got back to the office.



Over a month later and approx 6 unanswered emails and 3 or 4 unanswered voicemails and I am out of the original $100 for the item/shipping, an extra $20 I paid to ship it back and I don't even have the defective item.  I can't even leave him bad feedback at this point.



Since it's beyond the 90 day grievance time limit I guess I am out of luck.  Anyone aware of any possible recourse I can take?

How did you pay?  If you used your CC then your bank may do a chargeback for you.  You can also send the seller one last message saying:



Could you please refund my $100 plus $20 for return shipping immediately; if refund is not received in my PP account within 48 hours the matter will be handed over to on line fraud squad.


 


And if you do not hear, go for the chargeback and also report them to:

You have 45 days to open a dispute with pay pal


You have 60 days to leave feedback

This happened to me once too.  The item took TWO MONTHS to be sent from Malaysia (seller had their ID in US) and had said that they had sent the item and would get a tracking number "as soon as they returned to the office".  None was forthcoming.  



Incidentally during this time the seller became "no longer a registered used".   Eeek! And the item was a couple hundred bucks. 



After being exceedingly patient and polite, I politely told him that I would be beginning a CC fraud application if I didn't receive the item within the week.  Lo and behold, sent via express post and dated the day AFTER the email.  



Can I ask whether the item was Lego related?  This scenario seems awfully familiar!!
