eBay will do something if it's in their best interest. Just one person talking about bad ebay experiences, especially making a video and publishing it on YouTube may cause it to go viral.
It could also indirectly cause eBay to lose revenue from otherwise new seller registrations, and current seller markets already registered on eBay.
Not only that, if we as buyers become complacent to this type of seller behaviour, and not report such sellers, unethical sellers will dominate eBay.
I would report the seller to ebay, although that's what I would do, and not make it easy for unethical sellers.
It's about time sellers stopped selling items they cannot supply, that's just plain fraud, and no contract will allow you to hide from the legislation.

We should petition eBay to make it fairer for the buyer by implementing a policy that, cancelled sales must pay the buyer a % fee.
In as much as the same principle that sellers sometimes impose a restocking fee, if the order is cancelled by the buyer.

So you think that the poor buyer that hasn't lost anything must be rewarded, this is the most ridiculous idea ever.
You sound like you want to punish every seller for what a minuscule amount of sellers do.
Like I said in my other post it's Ebay's policies that are both fair to the seller and buyer so the blame needs to go towards the policies.
The seller has 3 choices to cancel and when the seller uses one of them which they're entitled to do along comes the poor buyer saying that's a lie.
After a few minutes tearing up the buyer should just get over it and move on.
And I'm a buyer and a seller just in case you wanted know.

Sellers are not able to apply a restocking fee on eBay anymore (and certainly never were able to for cancelled orders, only returns) - in limited circumstances, they can charge a buyer for a loss in value on an item if it is returned damaged, but the maximum allowed is 50% and that's only if the item is returned in a basically worthless state (in other words, the seller still has to suffer loss if the buyer returns an item that needs to be binned).
Sellers have to cop the non-refundable fees via PayPal if payment was made that way, regardless of the reason for return / cancellation.
If buyers want to be compensated for being put in exactly the same position as they were before they purchased an item, then fair's fair and buyers should at least have to pay for all the currently non-recoverable losses they cause, no?
Also, I think you should maybe have a read through the current policies on what is and isn't covered under the MBG - both version (i.e. the ones for sellers who are and aren't on managed payments as there's some difference, particularly in regards to pick up items).
