Seller does not have item

The seller doesn't have the item and yet it is both marked as sent and they are still selling those items in the community. They haven't accepted my responses and are claiming that the mistake is somehow mine. I think I'll be lucky to see any product at all at this rate.

So you open an item not received dispute of course and get your money back

 

If they have not 'accepted your responses' how have they claimed the mistake is yours?

 

What was the estimated delivery date?

 

Where is the seller registered ?

 

What is their feedback (as a seller) like?

I don't really understand all of your post.

 

The seller may be saying they don't have your item because it is in the post? Is that what you mean?

 

Or do you mean they never had the item?

And what is your so called mistake?

 

Sandypebbles has summed it up though. If you bought something and it is marked as sent and you're getting nowhere with a seller, just stop sending messages. Wait till the last estimated date of arrival has been and gone and open a claim with ebay for item not received.

 

You may not get the item but at least you'll get a full refund.

I think you have to add more details, as I agree with springy that your post is not quite clear.

How do you know that the seller does not have the item? Have they told you that the item is out of stock? If so, why do they claim that it was your mistake?

At any rate, concerning your last sentence (that you will be lucky if you get anything at all), you might not get your item, but if you don't, you can open a case and get your money back at least, as already mentioned. I know you would prefer your item, but it's better than nothing.
