If a seller posted a negative comment about a buyer because a transaction went bad. Can the comment be removed if it was found that the seller acted fruadulantly in the transaction; i.e: Mastercard Services found that the seller did not provide the product that was sold (no item arrived) and refunded the buyer in full and if the negative comment can be removed do I need to and how do I provide proof of the refund?

Yes - the extenuating circumstances are irrelevant, because it just boils down to whether the comment is deemed negative enough to conflict with a positive rating. If the feedback comment is reported to eBay, they will decide if it warrants removal and issue a policy violation to the seller if it does.
That is presuming the comment has been left as feedback for the buyer, anyway, rather than a follow-up to feedback left for the seller.

the policy says negative feedback comments left by a seller that directly contradict a positive rating will be removed.
