Seller not releasing the product

Hey Everyone-

Quick one. I've purchaed a product from a private seller. They are refusing to release the product becasue Paypal is telling them it could be up to 21 days before they receive payment. Who is in the right here? Should they be allowed to not release the product until Paypal releases funds? Also, I can't seem to find another way to pay for products on Ebay without my credit card going through paypal...is that correct?

Yes, sellers have every right not to send anything until payment has cleared, would you send something that you have not been paid for?  The seller does not have your money yet so like most sellers are not happy to send anything until they have been paid

How do they not have my $ yet when it has be taken from my credit card? We've purchased multiple items with no issues in the past. I'll check the verification, but again no issues ever with purchasing on Ebay.

Paypal is holding the funds, it has not been paid into their account, despite it being taken from yours. It is basically 'in limbo'

They do not have the money any more than you do until it is released to them

They do have the money. it is in their account, but is being held in accordance with Paypal policy. the buyer can't cancel the transaction, and the seller can get the funds released as soon as they can show delivery.

The seller should post. If they don't I would either open an INR (if the item is obtainable elsewhere) or wait and give them a neg and a defect for late delivery. If necessary, as eBay will defect automatically for late delivery if it's a parcel and tracking is uploaded.

What Paypal have advised the seller it seems...

Payment made $$$ however funds not cleared

The money has come from your credit card you can see it however the amount in the sellers account will show like this

eg: seller might have $$50 in their account plus your payment of (just estimate for eg purpsoe) $10.. Sellers account shows total $60 however seller can only withdraw $50 from their account due to Paypal withholding funds.

This used to happen regularly with the e cheque system... if customer purchased item using Paypal but did not have the sufficient funds in their Paypal account.  Paypal would not authorise the seller to send goods... it used to take 5 - 7 days. Once payment was cleared ie: funds drawn from bank account or credit card account to finance the Paypal purchase, Paypal would then notify the seller that it was now OK to send item.

21 days does seem like a long time... I'd the seller is obviously a new seller. 

Contact Paypal and see if they can help.

The seller is an idiot if they don't send until the funds have cleared. Clearly they have no read up on the T&C's. Advise them that when they list an item for sale, it will say that funds will be held for 21 days until certain criteria are met. Also tell them that as soon as tracking says delivered, ring PayPal and they will release the funds while they are on the phone.

EBay has stated (somewhere) that sellers aren't supposed to wait for the funds to clear. This seller is going to end up with a multitude of defects and bad feedback if he keeps doing this. His selling career will be very short. As Dave said, the funds are there, you have paid, he just can't touch them for 21 days. He should also have been told to post the item. He has to prove himself before he'll get instant payment.

If you go to the transaction in your Purchase History, click the dropdown at the right and select view order details. That should give you an estimate of when the item may arrive from when you paid. If the second date has passed, open an item not received dispute immediately by using that same dropdown and selecting I didn't receive my item.

i'm thinking this seller is new to selling, 

the holding of funds for 21 days has been here for a long time.

theres no reason not to post, funds will be released once either the 21 days expire or the seller shows proof of delivery to pp.

this seller is running the risk of multiple negs
