So basically I have until the 28th to open a case with PayPal before the 45 day requirement is up. I bought this phone which didn't worked as described on the store page and I have been "troubleshooting" with the seller for more than two weeks. I understand that are helping me to get it working again but it was wasted so much of my time.
The seller has told me that the warehouse will be closed over xmas so no dispatches or returns will be accepted.
So my questions are:

I would open the paypal case now....
If it's not as described, then I wouldn't have waited until this long - you are entitled to get what you paid for, as described!

Open a case immediately.
The seller does not need to be open as it is PayPal who will issue the refund.
When instructed to return the item via PayPal, be sure to post to the address given to you by paypal via a trackable method. Enter this tracking number into the paypal dispute.
Do not let the seller convience you to close this case.......paypal will instruct you now, not the seller.

If it is a mobile phone then you have to return it with a road only sticker on it as it contains a lithium battery, I hope the return address Paypal gives you is in Australia as you cannot send a mobile phone overseas using Aus Post.
Paypal are not in the least interesteds that the seller may not be around to receive the parcel, as long as you have sent it with signature required you have enough proof for Paypal that it has been sent.
Open the dispute now.
