How can I open a dispute if its more 45 days ago. This guy promise me to send a new Item . But nothing come up. I think he just buy he's time to so he can get away with it. I'm a sincere buyer of ebay. I don't want have a bad experience. It happened to me with rhe other site I dis not come back. PLS. HELP TO HOW TO DEAL WITH THIS.

NEVER allow the 45 days to pass to open the dispute no matter how obliging the seller seems.
If you funded the payment with a credit card then call your bank about doing a charge back other than that you can try the police.

You can't open a dispute after 45 days.
Never let a seller string you past that time. Of course he strung you past that time, as HE knows the rules
If your payment was funded with a credit card you might be able to get your bank to do a chargeback.
Otherwise you can report them to the police online fraud site. If they are in Australia? Guys don't yet live in Australia.
Rather than blaming sites, it might be handy if you actually apprised yourself of the conditions of the sites, worked out how Paypal works, in fact, work out how online purchasing works. Or go to your local real shop.

I'm sorry but this a valuable lesson for you and I am sure you will not let a seller do this to you again. Here is my advice to you:
1, always pay with a safe method like Paypal or Paymate or credit card if offered so you have some protection from bad sellers. never use bank deposit unless you have dealt with and trust the seller.
2, Always make sure you start a dispute before the 45 days from the sale are up, no matter what excuses the seller gives you. If you think the item is still coming and it is not the sellers fault you stall have another 20 days to escalate the claim which should give the item plenty of time to get to you, or the seller time to fix your problem.
3, If you have any problem with a sale that you don't know how to deal with ask her on the forums and accept and respect the answers you are given as most posters here are very experienced and generally know the rules.
