Seller sent me a "gift" saying that the item i ordered was a presale item and wont be shipped before the 20th NOV. They have instead sent a "gift " listing it as the item and its now showing "delivered" as if they sent the original item! They originally were replying to e-mails and have stated that the item is coming buy havent had a reply in three days. What do I do? Thanks
How did they say that?
Was it in a note inside the parcel with the 'gift'?
Or did they tell you this via the ebay message system?
From the sounds of it, the item they sent was with tracking, because it is showing as delivered.
I don't like the fact the seller is ignoring you & I don't like that it was listed as the item on the package. But the fact is, you did receive something and it was shown as delivered, so I think I am right in saying this, but don't open an ebay claim against them for item not received. They have evidence it was 'delivered'.
If the actual item you paid for is not with you though by the estimated date in the original ad, then I would open an item not as described claim, just as kopenhagen advised. And follow it through.
It's not on for sellers to list an item then tell buyers it was a presale item and not available yet. Sometimes sellers do run into delays because they list stuff they don't actually have on hand, but that's 100% their problem, not yours.
Don't let the seller try to talk you into waiting & waiting, don't be fobbed off. If the item you paid for is not delivered as advertised, you go straight into an item not as described claim and stick with it.

Listing an item as a Presale item is acceptable but must be available for shipping within 3 weeks.
Was there anything on the listing to show that it was presale?

You have 30 days after the last expected arrival date under the money back guarantee so wait until a few days after the 20th and then RING EBAY if nothing has arrived. Don't just open a claim as you need to get someone to look at the messages and confirm that they said it was a pre-sale item. If it really was a pre-sale item this has to be clearly stated in the listing but it sounds to me like they could be using this to defraud buyers.

You are obviously using the mobile site to access the forums, so we have no idea who you are replying to as each of your replies has you replying to yourself.
Open a dispute for item not received if the ETA has passed. When you've done that, come back here for more help. Given you are using the mobile site, so all your replies appear as replying to yourself, please mention the username of the person you are replying to when you reply. For example @tippy
Do you have an item number of the item you purchased? Don't mention the seller's name, just the item number.

@Tippy, surely you mean open a case for INAD?
Ebay will close the case automatically if they open for Not Received as there is a tracking number associated with the order.
