Seller wont close unpaid item case/update posted item details!!

This is driving me nuts...

 

Never again will I buy from someone with ZERO feedback.

 

I bought a phone from buyer - he didnt have option of Paypal only Bank Deposit & Paymate so I paid (regrettably now) via bank deposit - within 3 days of buying the item (& paying for it within 1/2 hr of auction finishing) an 'unpaid item dispute was opened by him"  - after constant backwards & forwards messages he finally said that yes my payment was in his bank account & he was sending the item & gave me a tracking number.

 

Since then he has not updated ebay to close the unpaid item case or update postage details & of course I havent received my item & the tracking number on the Aust Post website just states "initiated" & has been like that since last Tues!!

I keep sending him messages to close the unpaid item dispute & update postal details but I get nothing from him.

 

I cant open any disputes whilst his remain open & ebay keeps telling me I cant open dispute until the 1st March which is today but it still wont let me do anything?

 

My own stupid fault for not demanding paypal I suppose but I dont know what else to do here?

Why on earth didn't you use Paymate?  You at least have the facility to open a dispute and get your money back and you have the protection of your credit card.

With bank deposit you have no protection at all.  I have a feeling you will never see your purchase and ebay will not give you your money back.

You cannot "demand" paypal...the seller is already offering a safe payment method in Paymate and would have every right to refuse a paypal payment.

To my (limited) understanding, there's no recourse via eBay, so the dispute system is a moot point. You'd be looking at a police report of some sort, a process that I believe varies a bit depending on the locations involved.

I just wanted to point out that phones can be reported as stolen and have their IMEIs blocked both before and after you receive them. Even if you GET the device, don't be surprised if it becomes inoperable a week or two later.

The only way he can do that is to post it.

 

You can report the seller to the online fraud squad.

 

You already know the rest about using the safe payment method offered, but I will add that phones are at the top of the list of things you don't buy here, especially from 'new' sellers.

sounds like a scam

I didnt think (0) fback sellers could offer Paymate or Cr Card facilities until after a certain number of sales??

Contact your bank and see if you can initiate a reversal of funds.. Cite online Fraud...

And why do so many experienced (and I am sure quite trustworthy) sellers, send you their bank account details in an email thanking you for buying?

If you were a new buyer, you may just think that it is the done thing.

 

I bought a few things a couple of weeks ago from three different long time sellers and two of them wanted me to pay by bank deposit.
