bought a iphone paid by paypal now seller refusing to deliver ..is this a fraudlent act

Have they stated their reason for refusing to deliver? Is it to do with the item or your delivery address? Are they planning to refund you in full if they do not plan to send it?

It isn't fraudulent unless the item doesn't exist or they plan to keep your money. You paid with paypal, you are safe.

Remember you can still leave negative feedback for them if they refund - it's seller non performance. They sold it therefore they have to follow through.

Just don't be fooled into waiting too long or mutually accepting a cancel item request. If they send one, refuse.

Open INR now and escalate to claim as soon as the sytem allows you to.

So long as you paid by paypal you will be refunded.

No matter the reason the seller gives, they must do one or the other - send the item or refund.

Just checked seller - they are quite new, very low feedback - and have sold this item before and received feedback on 28 March for it.

They may be have a 2nd phone, but my guess is they sold it and have accidenatally re-listed or maybe trying to do the wrong thing.

If you do not receive the item, open up a dispute with Paypal for Item Not Received. Escalate to a claim when appropriate. You have 45 days from the date of purchase to rais a dispute/claim with PayPal.

Do not let the time expire as after this you have no protection at all.

if it is the phone purchased on 24 April - the terms say

Items shipped within 5-6 business days.

so the seller is not in default as yet - technically he has until friday or even monday to comply

unless you have been contacted by the seller advising he will not send?

Seller has already adivsed item will not be sent.
