eBay Commerce Australia Pty Ltd a scam or not. Cause I juste bought a leather jacket... and I wonder what is that company...

That would be eBay
The site where what you bought from was listed
You buy from the seller, you 'pay' eBay, eBay pays the seller
If you thought something was a scam, your first port of call surely would be contacting your bank
Did the amount your were charged match what you paid?
You are registered in Canada and posting on the member forum for eBay Australia
Were you logged in to eBay Australia when you purchased ?

I order from Montrรฉal Quรฉbec Canada, still waiting for a refund this coming monday as the seller said. This refund is being accepted by the seller. This amount was the custom fees , 41.00$ approximately. So far everything seems to be OK with the seller.

Not sure why the seller would refunds Customs fees.
They are your responsibility.
Why is the seller waiting until Monday? They can refund any time. Any refund goes to the original funding source (Paypal, bank account, etc) not your eBay account, so even if money is refunded on Monday it won't necessarily be in your hands for a few days.

Your heading asked if it was a scam
You made no mention of wanting a refund
And as said, the customs fee is not payable by the seller
Where did the 'scam' you ask about come into any of it?
And what does it have to do with Australia when you are in Canada, and you say the seller is too?
