what do we do when a seller doesn't send a item and waits until time passed for a refund by ebay it has been over 2mths for some item 5mths and not even returning emails.

Unless you funded your Paypal payment by credit card, there's absolutely nothing you can do, except next time take note of the 45-day claim period offered by Paypal for INRs.

the rfund would be from Paypal not eBay, and the seller did not make you wait. you failed to exercise your free 'insurance' offerd by paypal of getting your $$$ back as long as you claimed it within the 45 days as mentioned in the confirmation email they send when you pay.

 

buyers on ebay should learn to work within the system, and all will be fine  allowing a Seller to dictate to you when they will deal with the matter can only lead to  disaster

 

Paypal have a good Buyer Protection prgram which is entirely free to every Buyer... use it.

You are in control from start to finish - only ever pay using paypal, follow the guidelines, and open disputes within the time given.

The only one who can let the 'refund' time expire is the buyer, seller's have no control over that.
