I have ordered some items from a seller back in June last year. The seller operates 2 accounts and I have purchased some philatelic items from both account during the same period. I have paid honestly but the items did not arrive after the ETD.
On chasing up, the seller advised that the postal system was stopped and there were no mails from Spain to Australia and he asked me to wait until the postal system operates again. Since this is COVID and is an unavoidable issue to most period around the world, I agreed if in 3 months time the postal system does not operate, I will require a refund.
Instead, I have been very generous and after 7 months, I request for a refund. The seller then admit that he can now post my order. This takes another 2.5 months before something arrive. Unfortunately, the items I received is nothing resemble the items I have ordered.
I send an request to the seller listing my order/item numbers and description of the stuff he has sent me. He did not reply after another 4 weeks and after me chasing up another two times. He mentioned that this was too long and he cannot find anything in his system, or email. He just tell me to keep the items he sent as this is still good.
My problems are:
1. This is not the items I ordered and I have no right to access this. Someone who purchased these may have a better title than I am.
2. Items received are not what I want. They are not a total substitute of what I want.
3. Different items have different values in the eyes of different collectors. Items ordered by someone does not mean the same value as the items I have ordered. They does not have equal value and cannot be compared or treated as a good substitute.
4. What the seller thinks this is a good deal does not apply the same to me in any extent.
5. The seller is always irresponsive and takes a long time to reply my queries. This has shorten my right under the EBay guarantee system.
6. What the seller has promised even 10 months ago were not fulfilled. If you cannot make a promise, you should not make this.
7. The items I purchased from his other account has not arrived at all. He does not mentioned this.
I wish to complain to EBay, but unfortunately as the sale was made some 10 months ago, I cannot use the proper channel to report the case. Is there any other way I can report to EBay direct.

Unfortunately as you have stated you are well beyond the time given for either MBG or Paypal claims.
You can contact eBay on Live Chat, but I doubt there is anything they can/will do.
For future reference claim eBay MBG for any item not received, you can always re-pay the seller if and when your item arrives.
