Court stops payout to obese man

A court decision to award a morbidly obese man more than $350,000 from his doctor because the GP failed to refer him to a weight-loss clinic or send him for lap-band surgery has been overturned on appeal.


 


Emmanuel Varipatis, a Manly GP, said he was relieved the Supreme Court ruling had been overturned.


 


The medical fraternity had been concerned that holding doctors legally responsible for their patients' failure to shed weight would become an ''intolerable burden''.


 


The case involved Luis Almario, a Colombian-born revolutionary who once stood for state parliament.


 


He was in the care of Dr Varipatis from 1997 to 2011. The court found in February that Dr Varipatis had been negligent in not sending Mr Almario, 68, to an obesity clinic or arranging for a surgeon to assess his suitability for gastric-band surgery. Mr Almario weighed 140 kilograms and was 154 centimetres tall. Justice


Stephen Campbell found Mr Almario had terminal liver cancer as a result of liver disease linked to his obesity and awarded him $364,000.


 


A three-judge panel of the Court of Appeal has dismissed the judgment. It found the evidence of GPs did not suggest a doctor was obliged to do more than ''take reasonable care'' of a patient by advising weight loss - which Dr Varipatis had done. ''The duty of care stopped short of requiring an exercise in futility.''


 


Medical insurer Avant, which led the appeal, said the original decision had caused significant concern in the industry because it might have forced GPs to ''practise defensively''.


 


Dr Varipatis told GP industry journal Medical Observer he felt exonerated but was sorry for Mr Almario's state of health: "I realise that he and his family will be very disappointed and upset right now.''


 


Mr Almario, of North Parramatta, has been given less than a year to live and is being cared for at home by his wife. His solicitor did not return calls.

I am concerned as to the effect that this type of insurance claim will have on the cost of the consulting with a Doctor.


 


A few more claims like this will put the Doctors insurance permuins up through the floor and that will effect to prices Doctors have to charge.

I just wanted to say "Way to go, Vampire Teddy! I wish you luck in achieving the goals that you want to reach."


 


As for the obese man in the OP blaming his doctor - he's not a child, he surely knew the risks of his obesity, it's not like he couldn't have noticed himself that he was carrying a bit of extra weight. Maybe his doctor didn't send him to an obesity clinic, but what did he do to help himself? Did he ask his doctor for a referral? Had he even mentioned to his doctor that his weight was concerning him? Was his doctor even treating him for weight related problems, or was he just a "casual" patient who went to the doc every now and then when they got crook?


 


The man got cancer, for that I do feel empathy, but now trying to find someone and something to blame and pay for his lack of proactive action is a bit rough IMO.


 


I smoked for many years, my doctor knew about this, but unless I specifically brought it up (ie on one of my many attempts to quit) my doctor never addressed it if I was seeing him about something else iykwim.


 


If the courts had have ruled in this man's favour, it would have opened the way for people like me to sue their doctor if they happen to get smoking related cancer in the future.


 


And from there - it wouldn't be a big jump to people suing their Personal Trainers at the gym. Mine knew I smoked when I started, but did refrain from giving me the stop smoking lecture (and he is technically employed to assist me with being healthy) (He did however push me hard on cardio and I just reached the stage where I got sick of coughing up a lung every time I went for a run LOL)


 


 


Some people can go their whole lives and never really live for a single minute.

I took the surgical option, do you know it's NOT easy answer? It's NOT the cheats way out? Do you know I could still eat a full packet of biscuits, consume a tub of ice cream, if i chose to? I think you would be very surprised how many people fail to lose weight even after surgery! It only works for those who desperately want it to succeed!

No matter which way you choose to bend it in order to cover up for the fact, 98-99% of all larda...s are larda---s because they are just too lazy/dumb to look after their own physical interests.


The remaining 1-2% DO have medical reasons for being so, and should be helped as much as humanly possible.


 


It costs the Australian economy a fortune every year while the lazy/dumb larda...s still continue to refuse to take responsibility for their own lack of willpower to quit eating all the junk they consume and exercise properly.


 


Eat your way to an early death appears to be the growing national trend in this country these days.
