Delhi’s rape ruling outrage

A DELHI court has found a brutal sex attack which killed a 65-year-old woman was not rape because she didn’t appear to have fought back and “was beyond the age of menopause”.

As the nation struggles to come to grips with a string of sex killings, usually of very young girls, the latest verdict is seen as yet another example of officialdom’s lack of comprehension as to what rape actually is.

The 65-year-old woman was found dead in her home in 2010 with her 45-year-old attacker asleep, drunk, alongside her. Her body was smeared in alcohol and she had suffered internal injuries in the assault.

However investigators noted there was little sign of bruising or scratching which would indicate a struggle.

That does not mean it isn't rape. If the victim can reasonablly conclude that fighting back wouldn't work, stop the attack, it's still rape. As in the case where the attackers are the police. You have anywhere between 2 to 4 men who can call on more if they want, there's no end to the number of cops that can respond to assist in a rape, as was the case with me. Fighting back was not a viable option for me, trying to avoid or move away just resulted in extra charges and more lies on reports and in court.

If one can see that the power being used against them is much greater than anything they can possibally muster in their own defence, it's still rape. Rape is about exersizing your power over your victim, even more so than sex or intercourse.
